Terms of Service

These Terms of Service (“Terms”) govern your access to and use of tplgolf.com and the TPL Golf platform (“Service”), operated by TPL Golf (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

TPL Golf provides a web-based platform for managing golf leagues, including features for team and roster management, schedule generation, live scoring, handicap tracking, tee sheet management, messaging, and subscription billing. The Service is intended for golf league commissioners, players, and administrators.

2. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it as necessary.

You may not share your account, create accounts on behalf of others without their consent, or use the Service if you are under 13 years of age. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Organizations and Leagues

The Service uses an organization model. An “Organization Owner” or “Admin” (“Commissioner”) creates and manages an organization, which contains leagues, seasons, and members. Commissioners are responsible for all activity within their organization, including the accuracy of player data, scores, and settings.

By adding other users to your organization — including via CSV import or invite links — you represent that you have their permission to create an account on their behalf and that any personal information you provide about them is accurate to the best of your knowledge.

4. Payments and Subscriptions

Certain features require a paid subscription. Subscriptions are billed through Stripe on a recurring basis (monthly or annually, depending on the plan selected). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Commissioner fees are one-time per-season charges required to unlock certain season management features. These fees are non-refundable once the season is in an active state.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods except as required by applicable law.

5. User Content

You may upload content to the Service, including photos, videos, and messages (“User Content”). You retain ownership of your User Content. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely to operate the Service.

You agree not to upload content that:

• Violates any applicable law or regulation
• Infringes any third-party intellectual property rights
• Is defamatory, harassing, obscene, or harmful to minors
• Contains malware, spam, or unauthorized advertising

We reserve the right to remove content that violates these Terms without notice.

6. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation
• Attempt to gain unauthorized access to the Service or its infrastructure
• Reverse engineer, decompile, or otherwise attempt to extract source code
• Use automated bots or scrapers to access the Service without permission
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to send unsolicited communications (spam)
• Impersonate any person or entity

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and remain the exclusive property of TPL Golf. Our trademarks, logos, and service marks may not be used without prior written consent. Nothing in these Terms grants you any right to use our intellectual property.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, TPL Golf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TPL Golf and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction in those courts.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
